Terms and Conditions

These Terms and Conditions (“Terms”) form a legally binding agreement between you and brkpod (“we,” “us,” “our”) governing your use of brkpod.com (the “Service”). By creating an account or otherwise using the Service, you accept these Terms. This agreement is enforceable under the Information Technology Act, 2000, the Indian Contract Act, 1872, the Consumer Protection Act, 2019, and the Digital Personal Data Protection Act, 2023.

You must be at least 18 years old to create an account or use brkpod. By using the Service, you represent that you meet this requirement.

brkpod is a podcast note-taking platform. It lets you submit YouTube podcast URLs, at which point brkpod fetches the video’s transcript and helps you create and manage personalized, AI-assisted notes tied to your stated reason for listening. The Service is provided on an “as is” basis, as described further in Section 10.

Accounts are created and authenticated through Google Sign-In or with an email and password. You are responsible for maintaining the security of your account and for all activity that occurs under it. You can permanently delete your account at any time using the Delete Account option in your Profile settings, which takes effect immediately, or by emailing hello@brkpod.com.

• brkpod only supports podcast-length content of 60 minutes or longer, submitted via YouTube URL.
• You may not submit or use the Service to process illegal, hateful, or infringing content.
• You may not use bots, scrapers, or any automated means to access the Service, and may not attempt to reverse engineer any part of it.
• Any YouTube content you submit remains subject to YouTube's own Terms of Service.

The brkpod platform, including its design, code, and branding, is owned by brkpod. You retain ownership of the notes you create using the Service. Video transcripts remain the property of their respective content creators; brkpod provides them to you solely to support your own personal note-taking, not for redistribution or commercial use.

Notes and summaries generated through brkpod are powered by OpenAI’s language models. This content is not guaranteed to be accurate, complete, or up to date, and does not constitute professional, legal, medical, financial, or any other form of advice. You are responsible for independently verifying any AI-generated content before relying on it.

brkpod is currently free to use as part of an early access program. If we introduce paid features in the future, we will notify existing users in advance of any change that affects them.

To the maximum extent permitted by law, brkpod is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claim arising out of or relating to these Terms or the Service is capped at INR 1,000 or the total amount you paid brkpod in the 12 months preceding the claim, whichever is greater.

The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

You agree to indemnify and hold brkpod harmless from any claim, liability, damage, or expense (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.

brkpod relies on third-party services including Google, YouTube, AWS, and OpenAI. Each of these services has its own terms and policies, which apply to your use of brkpod alongside these Terms.

These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms or the Service is subject to the exclusive jurisdiction of the courts of Hyderabad, Telangana, India. Nothing in these Terms limits any right you have under the Consumer Protection Act, 2019.

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Grievance Officer for brkpod is:

Grievances are acknowledged within 48 hours and resolved within 15 days of receipt.

We may update these Terms from time to time. For material changes, we will provide at least 15 days’ notice before the change takes effect, by email or a notice on the Service.
